Welcome to DVB Dream, a service provided by TEPE. By using our service, you agree to these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing or using DVB Dream, a product of TEPE, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our service.

2. Eligibility and Account Creation

• You must be at least 16 years old to use DVB Dream.
• You must provide accurate, current, and complete information during the registration process.
• You are responsible for maintaining the confidentiality of your account and password.
• You agree to accept responsibility for all activities that occur under your account.
• You may not use false identities or impersonate any other person or entity.
• Accounts registered by "bots" or other automated methods are not permitted.

3. Acceptable Use

• Use DVB Dream only for lawful purposes and in accordance with these Terms.
• Do not use DVB Dream to violate any laws in your jurisdiction.
• Do not transmit any worms, viruses, or any code of a destructive nature.
• Do not engage in any activity that interferes with or disrupts the Service.

4. User Content and Responsibilities

• You are solely responsible for the content of your forms and the data you collect.
• Obtain necessary permissions from respondents for data collection and use.
• Do not create forms that collect sensitive information (e.g., passwords, credit card numbers) in plain text fields.
• Comply with applicable data protection laws.

5. Intellectual Property Rights

• You retain rights to the content you create using DVB Dream.
• DVB Dream' name, logo, service design, and all related features and functionalities are protected by copyright, trademark, patent, and other intellectual property laws.
• You may not copy, modify, reproduce, or create derivative works of DVB Dream or any part of our service without explicit written permission.
• Do not use DVB Dream' brand features or any confusingly similar marks as your own or in any manner that may cause confusion among users.

6. Payment Terms

• Paid plans are billed monthly in advance and are non-refundable.
• You are responsible for all applicable taxes.
• Prices may change with 30 days' notice.
• Failure to pay fees may result in the immediate termination of your account.

7. Cancellation and Termination

• You may cancel your account at any time through your account settings.
• We reserve the right to suspend or terminate accounts, at our sole discretion, for violations of these terms or for any other reason.
• Upon termination, your right to use the Service will immediately cease.

8. Service Modifications and Availability

• We may modify, suspend, or discontinue any part of the service at any time without notice.
• We are not liable for any service modifications, interruptions, or discontinuations.
• We do not guarantee that our service will be available at all times or be error-free.

9. Disclaimer of Warranties

To the fullest extent permitted by law, TEPE and its affiliates, suppliers and distributors make no warranties, either express or implied, about the services. The services are provided "as is" and "as available". We also disclaim any warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, in no event will TEPE, its affiliates, suppliers or distributors be liable for:

(A) Any indirect, special, incidental, punitive, exemplary or consequential damages, or
(B) Any loss of use, data, business, or profits, regardless of legal theory.

This will be regardless of whether or not TEPE has been warned of the possibility of such damages, and even if a remedy fails of its essential purpose.

TEPE's aggregate liability for all claims relating to the services shall in no event exceed the greater of $100 or the amount paid by you to TEPE for the past 12 months of the services in question.

11. Indemnification

You agree to indemnify and hold harmless TEPE, its affiliates, officers, agents, employees, and partners from any claims, losses, damages, liabilities, including legal fees and expenses, arising out of:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another
• Any content you create, submit, or distribute using our Service
• Any actions taken by third parties using forms or content you create with our Service

12. Changes to Terms

• We may update these terms periodically without notice.
• We will notify you of significant changes by posting a notice on our website or sending you an email.
• Continued use of DVB Dream after changes constitutes acceptance of the new terms.

13. Governing Law and Dispute Resolution

• These terms are governed by the laws of the jurisdiction where TEPE operates, without regard to its conflict of law provisions.
• Any disputes arising from these Terms will be resolved through binding arbitration in accordance with relevant arbitration rules.
• YOU AND TEPE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.

15. Entire Agreement

These Terms constitute the entire agreement between you and TEPE concerning the Service and supersede any prior agreements.

16. User Representations

You affirm that you are either more than 16 years of age, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service.

17. Force Majeure

TEPE shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond TEPE's reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation, acts of God, terrorist attacks, or government actions.

18. Export Control

You agree to comply with all applicable import, re-import, sanctions, anti-boycott, export, and re-export control laws and regulations, including all such laws and regulations that may apply to a direct or indirect transfer of, or provision of access to, TEPE's services and data.

19. No Agency

No agency, partnership, joint venture, or employment relationship is created as a result of these Terms and neither party has any authority of any kind to bind the other in any respect.

20. Waiver

The failure of TEPE to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

By using DVB Dream, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.
